The man that killed Chandler Police Officer David Payne was extremely intoxicated at the time of the collision. In fact, he was nearly four times the legal limit. What's more, the drunk driver had a suspended license for a prior DUI offense at the time he took Officer Payne's life. UNACCEPTABLE. <br />

Sadly, another Chandler Police Officer has died as a result of a drunk driver. Officer David Payne, a seven-year veteran of the Chandler Police Department was rear-ended on his motorcycle near the intersection of Chandler and Dobson roads. According to his fellow officer, Officer Payne was a dedicated member of the DUI enforcement team. He died in the line of duty. <br />

For the second time in a matter of weeks, the child of a drunk driver has died. Phoenix police say the impaired driver, who was not identified, lost control of his vehicle in the area of 3500 North 75th Avenue in Phoenix and "t-boned" a pickup truck. A woman driving a Chevrolet was transported to the hospital in extremely critical condition.<br />

This was another preventable drunk driving accident. Personal responsibility, plan your trips so you always have a designated driver available. This is SO inexcusable!<br />

Not suprisingly teens are the most likely to be distracted. The combination of limited driving experience and the distractions of modern life are recipe for disaster for teens. As hard as it is to wait to respond to that text message or read the latest e-mail, it's not worth it!! <br />

A City of Phoenix employee was injured at 24th Street and Pecos Rd. in Ahwatukee today. A distracted female driver was reaching for a bottle in the back seat of her SUV when she struck and seriously injured the municipal employee. It is our present understanding the at-fault driver had two children under 5 years old in the back seat at the time of the collision.<br />

Distracted driving is a cause of thousands of accidents in Arizona annually. Distractions inside a car are the number 2 cause of distracted driving accidents (behind outside distractions - i.e. looking at another accident). Cell phone usage is the 3rd most frequent cause of distracted driving accidents in Arizona.<br />

Distracted driving causes nearly 11% of Arizona traffic accidents. According to a recent study by Arizona's Department of Public Safety, the most frequent cause of distracted driving accidents our "outside" influences, which account for nearly a quarter of all distracted driving accidents. Second to outside influences was reaching from something inside the vehicle. After that (and a surprise to some) was cell phone usage.<br />

ADOT does an annual evaluation of drunk driving accidents and details their findings. The statistics are scary. By way of example, the number of drunk driving accidents accounts for less than 5% of all traffic accidents in Arizona. However, nearly 33% of all traffic fatalities in Arizona result from drunk driving accidents.<br />
<br />
Thousands of innocent people are injured in drunk driving accidents. The economic toll of drunk driving accidents is equally staggering. Annually, nearly $500M in damages flow from drunk driving accidents. There is a great deal of additional detail in the report with respect to when drunk driving accidents are most likely to occur: time of day, day of week, time of year, etc.<br />

There is a sad and disturbing story in today's Arizona Republic about a lack of accountability in a young woman's death at the hands of a drunk driver 21 years ago (http://www.azcentral.com/story/laurieroberts/2014/08/04/rose-marie-maher-angela-gloria-schulze/13491551/). <br />
<br />
This story illustrates the struggle family's of drunk driving victims sometimes go through. While victim advocacy in the criminal courts has come a long way in the last two decades, letting a known killer escape is a wrong the must be made right. Unfortunately, the interests of the victim(s) of drunk driving accidents aren't always a top consideration in prosecuting DUI offenses. But victims deserve to be heard and offenders deserve to be punished.<br />

Arizona officials seem to have been caught on their heels with the high number of recent and deadly wrong-way crashes on Arizona's freeways. ADOT is continuing to study sensors to detect and alert DPS to the presence of wrong-way drivers. But is this really a DPS or ADOT problem? Keeping drunk and impaired drivers off the roadways is step one to preventing drunk driving accidents. DPS is the last line of defense and they are making a valiant effort to curb the problem, but there is only so much they can do.<br />
<br />
To stop drunk driving accidents, we all need to be more proactive on educating and reminding people about the importance of designated drivers, reminding bars about the liquor laws and tips and tools to identify patrons showing signs of intoxication. Too many innocent people are dying or being seriously injured in drunk driving accidents.<br />

This is beyond absurd. Yet another wrong-way collision occurred last night along the Interstate 17 near Downtown Phoenix. According to news reports, approximately 20 calls were made to 911 alerting them of the wrong-way driver, but they were unable to stop him before he caused the crash. At least two people, including the wrong-way driver, were critically injured and had to be extricated from their vehicles.<br />
<br />
The wrong-way driver is being investigated for possibly being under the influence of alcohol or drugs at the time of the crash. The frequency of wrong-way crashes is alarming. The Arizona Department of Transportation is scrambling to figure out solutions, but they seem pre-occupied with notification systems. As indicated by last night's wrong-way crash, notifying DPS of a wrong-way driver is NOT the problem. Impaired driving is THE problem.<br />
<br />
The horrific wrong-way crashes that have occurred around Phoenix over the last several months generally have a common denominator - a driver that was under the influence of alcohol or drugs. AZ Central has a timeline chronicling the wrong-way driver problem and providing further perspective on the severity of these crashes and the toll they take in terms of injury and death.<br />

While ADOT focuses on education, enforcement, and engineering, we need the Office for Highway Safety and others to focus on reducing the number of drunk drivers on the roadways. Interstate 17 northbound was closed this morning for five hours after an driver, believed to be impaired, collided with a broken down vehicle on the side of the road. This accident occurred near 7th Street in Phoenix and the innocent bystander may have suffered life-threatening injuries. Despite the severity of this drunk driving accident, the driver that caused the collision, fled the scene. A DUI investigation is presently pending. <br />

Today, a driver that caused a deadly accident along the 202 in Gilbert in 2013, was charged with manslaughter, aggravated assault, and drug possession. The driver was apparently on meth at the time of the crash and collided with a DPS vehicle parked along the side of the freeway. The DPS employee was injured and the driver's passenger was killed.<br />
<br />
Sadly, the frequency of drug or alcohol related crashes in Arizona and elswhere remains disturbingly common. Did you know that one in four drivers in Arizona is uninsured? It's a scary thought. Being a defensive driver and taking evasive action to avoid accidents is always a good tactic on Arizona's roadways, but sometimes there's nothing you can do. So, anyway to protect yourself and your loved ones? The answer is yes, at least financially. <br />
<br />
The way to do so is to ensure you purchase under and ininsured motorist coverage. These coverages are typically referred to as UM (uninsured)/UIM (undinerinsured). You can usually get upwards of $500,000 in UM/UIM coverage, which applies to anyone in your vehicle at the time of a collision and is also "portable" if you are in someone else's vehicle resulting in injury. The cost-benefit isn't even close. If you can afford it, buy it.<br />

PS - This is the subject of another blog article, but medical payments coverage is another "no-brainer." It costs next to nothing and can play a major part in defraying medical expenses as a result of a motor vehicle accident.<br />

Sadly, another wrong-way (head-on) accident occurred today. Glendale PD believe it was caused by an underage impaired driver. Arizona's roadways are becoming increasingly dangerous as a result of wrong-way accidents. ADOT and others are struggling to find a solution to the growing problem.<br />

In the last few months, several innocent people have died as a result of wrong-way collisions caused by drunk drivers. <br />

If you own a dog there is a possibility that your homeowners insurance policy may exclude coverage if your dog bites somebody. If this occurs, you may be personally responsible for the damages that were caused by the dog bite. Typical dog bites result in thousands of dollars of expenses. According to insurance statistics, the average cost paid out for dog bite claims exceeds $29,000. <br />

Many people do not know that typical homeowners insurance policies exclude coverage for “aggressive” dogs, such as Pit Bulls & Staffordshire Terriers, Doberman Pinschers, Rottweilers, German Shepherds, Chows, Akitas and many other breeds of dogs. Furthermore, some insurers exclude coverage for any dog that has bitten a person in the past or has not received state required vaccinations. To top all of this off, insurers may deny coverage for dog bites if the insurer was not aware the homeowner owned a dog.<br />

To protect yourself, your loved ones, and the assets you have worked hard for, make sure you inform your homeowners insurer if you own a dog. Furthermore, update your homeowners insurer any time you get a new dog. If your homeowners insurer does not cover your dog, look into an additional writer for pet insurance and make sure they cover your specific breed of dog.<br />

Med pay is an optional automobile insurance coverage not required by Arizona law. As with any insurance, you may ask why you should have it and is the additional cost worth the benefit? No situation is alike, but in general, med pay is a a low cost option that can help defray or eliminate the out of pocket expense of treating accident-related injuries regardless of whether or not your at fault for the auto accident. Different insurance companies have different med pay limits ($5,000 is often the max), but it's certainly worthy of discussion the next time you meet with your broker and evaluate your existing automobile insurance.

This month we speak on a topic that is often overlooked and definitely misunderstood (sometimes misrepresented) – Motor Vehicle Insurance. Pinching pennies on this coverage can have unfortunate consequences.<br /><br />It is estimated that there are presently 5 million licensed drivers within Arizona. Of this sum, approximately 25% are uninsured and a much higher percentage are underinsured. This probably includes you. Surprisingly enough, our exit polls reveal the majority of you are underinsured. If you are one of those living under the "it can't happen to me" philosophy hopefully it will not-but it can.<br /><br />The State of Arizona merely requires that you must carry insurance that will pay a guaranteed minimum of $15,000 per person injured, with a guaranteed minimum of $30,000 total coverage for the accident. In Arizona, the required minimum for property damage is $10,000 (on an insurance policy, the coverage limits would be shorthanded as 15/30/10). Further, all individuals can elect to carry a minimum of $15,000 per person and $30,000 per occurrence of underinsured and uninsured (UIM/UM) policy limits. The maximum amount of UIM/UM coverage cannot exceed your liability limits.<br /><br />Assuming you carry the statutory minimum of liability insurance (15/30/10) and you are in an accident that is your fault, there will be a maximum of $15,000 of insurance coverage available per individual injured for a total of $30,000 per occurrence. So, if two people are injured in an accident that you cause and each of those people sustain injuries that total $25,000, the minimum insurance will not cover their total damages. Each will only receive $15,000. If you are in an accident and it is someone else’s fault and they have inadequate or no insurance, the maximum available to you and your passengers will be $15,000 per person and $30,000 per occurrence, assuming you purchase UIM/UM coverage. If you follow the trend of accidents in Ahwatukee Foothills and the Phoenix Metropolitan area, by and large, this amount of coverage is not going to be enough to protect you and your loved ones in anything other than a minor fender bender. "In countless cases individuals lacked adequate insurance on both sides of a loss." Not only is there a general mentality that “it cannot happen to me”, but there is also a belief that less insurance is better to avoid being forced into litigation. This is nonsense.<br /><br />Automobile insurance also includes coverage for property damage, a rental vehicle, roadside assistance, etc. Most of these areas are self explanatory and relatively easy to evaluate, especially when it comes to property damage and deductibles.<br />Medical payment coverage, however, is another area that is often misunderstood. The common representation among many insurers and brokers or agents is that those who have health insurance do not need medical payment coverage. We don’t know what health insurance policy these folks possess, but it is not any that the majority of us own or are covered under. Deductibles, co-pays, uninsured conditions, balance billing, etc., all are reasons that medical payment coverage is cheap insurance. If this is not enough, all you need to know is that the majority of policies do not require a repayment of medical payment coverage in connection with any personal injury claim. Further, it is a no fault benefit, so to speak. Translated, your insurer will provide this coverage regardless of fault. <br /><br />Cyclists, walkers, roller-bladers, joggers, and general outdoor enthusiasts who brave our streets, don’t forget your vehicle insurance may apply to a loss you or a loved one suffers that involves a motor vehicle. The simplest example is being hit by a car. But there does not necessarily need to be contact with a motor vehicle.<br /><br />For those of you going to Mexico, don’t forget to cross the border with your Passport and Mexican Auto Insurance. Costco even sells this insurance now. Many US insurers require Mexican Insurance on your vehicle as a prerequisite to any coverage in Mexico for an accident. Check with your insurance representative and then check again as to what is required for your US Policy to protect you in Mexico.<br /><br />There is no magical formula as to calculating what appropriate liability, underinsured or uninsured policy limit is. You need to assess your financial needs and driving patterns to purchase adequate protection. Consult with a lawyer who does this type of work or an insurance agent who is keen to your personal situation. Then choose the coverage that is right for you.<br /><br />Like death, many avoid planning for the catastrophic events that occur with regularity in our mobile society. It's particularly prevalent in the Southwest due to hard water reacting with certain styles of brass fittings. Below is a FAQ page along with pictures that can provide some insight on whether you may have the problem at your home: <br /><br />Yellow Brass FAQs<br /><br />What problems are associated with yellow-brass fittings and components?<br /><br />The PEX plumbing systems are for residential use and have been widely used throughout the United States. These plumbing systems consist of plastic pipes and brass fittings. Only the brass fittings used to connect PEX pipe and the components installed as part of the PEX plumbing systems are the subject of these claims. These homeowners allege that high zinc, yellow-brass fittings and components are defective because they dezincification.<br /> <br />Dezincification is a process whereby zinc leaches from brass, which is an alloy of copper and zinc, thereby creating a white powdery buildup on the inside of the fitting and a weakening of the brass fitting. Dezincification can lead to, among other things, restricted water flow and an increased likelihood of the brass fitting leaking or breaking.<br /><br />What is the claims process?<br /><br />This process can vary by state and you are encouraged to seek the advice and you are encouraged to seek the advice of an attorney licensed to practice law in your area. A lawyer experienced in handling yellow brass claims is best equipped to determine if you have a claim and the method required to protect your rights. <br /><br />Various states have processes that must be followed to pursue claims against your home's builder and plumber. In some areas, you or someone on your behalf, must first provide notice to your home's builder. Experts retained on behalf of various homeowners have alleged the only proper method to repair these defective plumbing systems and to comply with the Federal Lead Free standards is to replace the entire system. This would include all pipes, fittings, shut-off valves and other components installed in connection with your home's PEX plumbing systems.<br /><br />Do these allegations involve personal injury claims?<br /><br />These claims do not involve claims for personal injury. If you have any reason to believe that you have suffered any adverse health effects because of these yellow-brass fittings and components, you should contact a health professional.<br /><br />How do I find out whether I have a PEX plumbing system in my home?<br /><br />A home plumbed with a PEX plumbing system may have a yellow or neon sticker on the inside panel of its electrical box. However, before you check, please be sure that you have experience with the location and safe use of your home’s electrical panel box. The purpose of these stickers is to alert electricians regarding proper electrical grounding procedures for nonmetallic plumbing. Often, homes with a plastic PEX plumbing system will have stickers such as the one to the right (on the website). Thus, if you find such a sticker in your electrical panel box, it is likely that your home contains a plastic PEX plumbing system which contains yellow-brass fittings and components.<br /><br />Please note however that many homes that contain a yellow-brass plumbing system do not have stickers in their electrical panel boxes. Thus, if your electrical panel box does not reveal a sticker indicating that a PEX plumbing system was installed in your home, you may need to have your home inspected to determine the type of plumbing installed in your home.<br /><br />As a claimant, am I responsible for attorney’s fees and costs?<br /><br />Most attorneys experienced with handling yellow-brass claims do so on a contingency basis. This arrangement means the legal fees are contingenton the outcome of the case. In other words, a lawyer hired on contingencywill not take fees from clients unless and until a monetary award of damage is received either at or prior to trial. In simplest terms, fees are not assessed unless you win your case.<br /><br />If my home has yellow-brass fittings and components, what are my repair options?<br /><br />It is believed that the only adequate repair method is a complete re-plumb of both the hot and cold water lines of your home. Generally, a full re-plumb takes approximately five (5) days for most homes to be completed and does not require relocation.<br /><br />If you decide to re-plumb your home at your own expense prior to the final resolution of the claims process or litigation, you may consider doing so, however, we would ask that counsel be notified of any anticipated repairs.<br /><br />What do I do if I have a leak?<br /><br />Treat it as you would any other leak, including taking steps to minimize any damage and contacting your homeowner's insurance carrier. If a leak occurs, immediately notify your plumber to stop the leak and to minimize any damage to your home. If a repair is required, keep all receipts and documentation of the repair. Please make sure to keep any fittings, pipe or plumbing components that must be removed to carry out the repair. Unless you have an abundance of time or are particularly handy, you will probably have to outsource the work to a professional. To help ease the process, we would like to outline some things to be mindful of as you reconfigure your backyard oasis. <br /><br />It goes without saying that hiring an unlicensed contractor is fraught with problems. What do you do in the event they walk away with your money, do unsatisfactory work, or damage your property in some way? Cry. Unfortunately, licensed contractors are not infallible and come with their own set of problems. This is especially true in today’s economy. Contractors have been among those most impacted by the downturn in the Phoenix housing market and many people with contracts in hand have been left with incomplete or deficient work, lost a significant amount of money, and have no idea where to turn. Before addressing what to do in the event something goes wrong, lets start by discussing how to find the “right” contractor. <br /><br />As you might expect, choosing a contractor based on referrals from friends or family is a good place to start. Additionally, having a couple contractors bid a project can give you a sense for the financial leap you are going to have to make. But by no means is that where your search should end. It is also prudent to take your dwindled list of potential contractors and research them on the Registrar of Contractors (“ROC”) website (http://www.rc.state.az.us/). There is a search function (“Check a Licensed Contractor”) that allows you to research a particular contractor. The results of this search will provide you with important information, including, the longevity of the business, the number of open and closed complaints filed against a particular contractor, whether that contractor was disciplined for those claims or if they have resolved all outstanding issues. As an educated consumer you can more thoroughly examine potential contractors and improve your chances of a satisfactory project. <br /><br />After you have found the “right” contractor, the next stage is completing a contract. Most contractors use a standard form contract that they may not even understand. Regardless, it is important to be aware of the implications in the event the project is not completed to your satisfaction, or sadly, perhaps it is not completed at all. Ideally, you can secure the advice of an attorney. In the event you do not have the time or money to consult an attorney, there are several items to be mindful of when completing a contract that will protect your interests. At the risk of stating the obvious, at a minimum, ensure the contract is in writing, outlines the work being performed, the financial terms, completion date, and process for resolving any disputes. <br /> <br />Hopefully, your project goes off without a hitch. If, however, you run into problems and are unable to amicably resolve your dispute, you may have to file a complaint with the ROC. Typically, such a claim results in an inspection by a ROC representative, who will itemize a list of “corrective work” the contractor that must complete to avoid further scrutiny by the ROC. Presently, the law affords contractors fifteen days to complete work outlined by an ROC Report, unless the contractor and homeowner reach an alternative agreement to hold the claim(s) until the corrective work is performed to the homeowner’s satisfaction. Hopefully, a satisfactory conclusion can be reached. If not, formal litigation may be the appropriate next step.<br /><br />In the event your licensed contractor succumbed to the struggling economy, legitimately or otherwise, you will likely need to file a claim with the ROC’s Residential Contractor Recovery Fund. The Recovery Fund provides an avenue to recover some monies you have paid to a licensed contractor that becomes insolvent or otherwise fails to complete the work for which they are paid. The good news is that it highlights the relative safety of using a licensed contractor.
